Jennifer Becker is a Shareholder of Bonezzi Switzer Polito & Hupp Co. L.P.A. Ms. Becker concentrates her practice in the defense of physicians, hospitals, nursing homes and other healthcare professionals in litigation involving claims of professional negligence related to patient care. In addition, she handles general liability defense claims against property owners, employers and companies.

Ms. Becker has assisted in the trial of several cases in a number of jurisdictions throughout Ohio. She has written numerous appellate briefs for several Ohio appellate courts, as well as the Supreme Court of Ohio with favorable outcomes for her clients. She has also argued cases in the Fifth and Eighth Districts.

Edward Papp is a Shareholder in the firm’s Cleveland office having joined the firm in February of 2017. He has been practicing law since 1997 and has over eighteen years of experience representing companies involved in toxic tort litigation. Mr. Papp has handled all phases of litigation for manufacturers, suppliers and contractors involved in asbestos litigation from initial client investigation to trial. He has represented companies facing both product liability and intentional tort claims.

Mr. Papp has experience serving as National Coordinating Counsel for multiple defendants in asbestos litigation. In that capacity, he manages the cases across multiple states coordinating the defense of clients in various jurisdictions. Mr. Papp focuses clients not only on the short-term challenges of individual cases, but also the long term impact the litigation could have on other areas of their businesses. He is keenly aware of the necessity to remain aggressive and proactive in a cost-effective manner while keeping the broad implications of the situation in mind.

Mr. Papp has served as Ohio defense liaison counsel in multiple groups of asbestos cases. This work entails being the defense point person in administration of case-flow, overseeing of discovery and pre-trial issues as well as reporting to courts and other defendants in the cases.

Steven Hupp is a Shareholder and one of the founders of the firm. He has been an attorney since 1988. Mr. Hupp began trying medical malpractice cases in 1990, and has now tried over one hundred cases as first chair trial counsel. He has represented nursing home/long-term care clients for the past nine years.

Mr. Hupp has practiced as appellate counsel in the United States Supreme Court, the Ohio Supreme Court, the Federal Sixth Circuit Court of Appeals and several Ohio District Courts. After completing a clerkship in the Eighth District Court of Appeals with the Honorable Blanche Krupansky in 1990, Mr. Hupp's practice focused exclusively on the defense of medical malpractice claims against physicians and hospitals.

Beth Sebaugh, Shareholder, has devoted more than three decades to an active litigation defense practice and has served as chief trial counsel in cases pending in state court, federal courts and before numerous governmental administrative agencies. She has actively defended numerous contract related lawsuits and has garnered a plethora of published opinions favorable to her clients involving contract law, private school law and various charitable organizations.

Donald Switzer is a Shareholder as well as one of the founders of the firm. Diane L. Feigi is an Associate in the firm’s Cleveland office. She concentrates much of her practice on the defense of companies involved in product liability and toxic tort cases in state and federal courts throughout Ohio. Ms. Feigi represents companies involved in premises and intentional tort matters as well. She focuses primarily on asbestos litigation and has experience in defending benzene-related cases.

Previously, Ms. Feigi was associated with a law firm that served as national litigation counsel for a major steel conglomerate. In that role, she assisted in overseeing the coordination of the defense of asbestos cases filed in state and federal courts throughout the United States. Ms. Feigi has also served as coordinating defense counsel in the Cuyahoga County, Ohio asbestos litigation, which has given her the opportunity to work closely with opposing counsel and her fellow defense counsel in the development of case discovery matters.

Ms. Feigi has extensive deposition experience, having served as lead defense counsel at dozens of plaintiff and coworker depositions. She also appears in court regularly at hearings and oral arguments on behalf of her clients. In addition, Ms. Feigi has been involved in mediations and settlement conferences in successful efforts to bring about resolution of her clients' cases.

Ms. Feigi has also had experience in domestic relations cases and has represented individuals seeking Social Security Disability benefits. She has also worked on insurance coverage cases, including litigation stemming from the Scott Pontzer decision.

Mr. Polito has been the lead trial attorney in excess of seventy-five jury trials. His trial experience has covered almost all of the recognized medical specialties.

Mr. Polito has been a frequent lecturer to medical residents on the subject of medical malpractice litigation. In addition, he has presented several continuing education programs on the same topics.

Mr. Polito has been named an Ohio Super Lawyer from 2010 through 2017; and has been named to "The Best Lawyers in America" from 2008 through 2017. He further enjoys an AV Preeminent rating with Martindale-Hubbell.

Jeffrey Van Wagner is the Managing Shareholder of BSPH. His career as a litigator and trial attorney has now spanned three decades. He is a 1979 graduate of Case Western Reserve School of Law and has extensive litigation and trial experience in the areas of nursing home liability, medical malpractice defense of physicians and institutions, general negligence and product liability.

Mr. Van Wagner’s full service endeavors for his clients also include providing claims and risk management services and presentations for clients, interactions with state and federal agencies, participation in civil and criminal investigations and pre-suit evaluation and assessment of potential claims.

The author of various articles and a frequent presenter to medical, nursing home and insurance clients, he has extensive experience with trials in courtrooms throughout the northern tier of Ohio.

Mr. Van Wagner is a member of the Ohio State Bar as well as the United States District Court of Ohio (Northern and Southern Districts), the Sixth and Fifth District Courts of Appeal.

Mr. Van Wagner was selected as an Ohio Super Lawyer for eleven straight years (2007 through 2017). In 2013, 2014 and 2016 he was also named as a Cleveland Top 50 and Ohio Top 100 Ohio Super Lawyer.
