William D. Bonezzi is a Shareholder as well as one of the founders of the firm. He has been a practicing attorney since 1973 and his legal career has been devoted to trial work. His competitive nature, developed in college athletics and honed in the U.S. Marine Corps where he served his country from 1965 to 1968, is ideally suited for confidently litigating the most difficult cases.

Mr. Bonezzi was admitted to the Florida bar and currently possesses licenses to practice law in both Florida and Ohio. He will be concentrating his practice in the State of Florida where he manages the Florida office. He will continue to concentrate his practice in Medical Negligence, Long-Term Care, Product Liability, Environmental and all aspects of General Liability.

Primarily defending catastrophic injury and/or death cases, Mr. Bonezzi’s reputation for integrity and hard work is well known in the legal community. He is most satisfied when on his feet in a courtroom.

Mr. Bonezzi has tried to verdict in excess of 200 cases in all phases of his practice throughout multiple states including Ohio, Missouri and Kentucky. Steven Hupp is a Shareholder and one of the founders of the firm. He has been an attorney since 1988. Mr. Hupp began trying medical malpractice cases in 1990, and has now tried over eighty-five cases as first chair trial counsel. He has represented nursing home/long-term care clients for the past seven years.

Mr. Hupp has practiced as appellate counsel in the United States Supreme Court, the Ohio Supreme Court, the Federal Sixth Circuit Court of Appeals and several Ohio District Courts. After completing a clerkship in the Eighth District Court of Appeals with the Honorable Blanche Krupansky, Mr. Hupp’s practice focused exclusively on the defense of medical malpractice claims against physicians and hospitals.

Bret C. Perry is a Shareholder in the law firm of Bonezzi Switzer Polito & Hupp Co. L.P.A. in Cleveland, Ohio. Mr. Perry concentrates his practice in the areas of the defense of physician, nursing, hospital, long-term care, aging services and assisted living malpractice claims. In addition, Mr. Perry is routinely called upon to represent the interests of ancillary healthcare providers including those employing home health aides, physical therapists, medical and radiology technologists, orthodontist and dentists. Mr. Perry has extensive trial experience handling complex multi-million dollar malpractice claims through jury verdict as well as extensive appellate experience before both state and federal courts of appeal and the Ohio Supreme Court.

Most recently, Mr. Perry argued before the Ohio Supreme Court in Havel v. Villa St. Joseph, et al., 2012-Ohio-252, in support of R.C. 2315.21(B) which established a litigants right to a bifurcated trial when both compensatory and punitive damages have been alleged. The Ohio Supreme Court agreed with Mr. Perry's arguments and reversed both the trial and appellate court's prior decisions finding that the statute was unconstitutional. The efforts of Mr. Perry now ensure that Ohio litigants are guaranteed the right to a bifurcated trial pursuant to R.C. 2315.21(B) when claims for both compensatory and punitive damages have been alleged.

In 2013, Mr. Perry again argued before the Ohio Supreme Court in the matter Johnson v. Smith, 131 Ohio St.3d 235, wherein the Court in a unanimous decision reinstated a jury’s verdict in favor of the defendant-physician following the appellate court’s reversal. In Johnson, the Court considered the admissibility of a physician’s statements of apology and whether said statements could be used against the physician at trial as an admission against interest. In rejecting the reasoning of the appellate court, the Ohio Supreme Court held that a physician’s statements of apology, act of benevolence and general conduct expressing sympathy was not admissible at trial and could not be utilized as an admission against interest.

In light of his expertise, Mr. Perry is a frequent lecturer to hospital facilities and their staff and currently serves as the Chairman of the Ohio Association of Civil Trial Attorneys Medical Malpractice and Nursing Home Litigation Committee and Medical-Legal Liaison to the Northeast Ohio Academy of Medicine.

Prior to joining BSPH, Mr. Perry served as a judicial staff attorney to the Honorable Nancy R. McDonnell, Presiding Judge, of the Cuyahoga County Court of Common Pleas, and as an appellate staff attorney to the Honorable Michael J. Corrigan and Frank D. Celebreeze of the Eighth District Court of Appeals.

Mr. Perry is a U.S. Navy veteran having served during the Desert Shield and Desert Storm conflict. In addition, Mr. Perry has been recognized by his peers as an Ohio Super Lawyers Rising Star from 2009-2012, and as an Ohio Super Lawyer for the years 2013 and 2014. Most recently, for the year 2014, Mr. Perry was voted one of the top 50 lawyers in the greater Cleveland area and top 100 lawyers in the State of Ohio by his peers.

Beth Sebaugh, Shareholder, has devoted more than three decades to an active litigation defense practice and has served as chief trial counsel in cases pending in state court, federal courts and before numerous governmental administrative agencies. She has been chief counsel in approximately one hundred jury trials inclusive of medical malpractice, professional negligence, employment law, catastrophic personal injury, product liability and death cases. Donald Switzer is a Shareholder as well as one of the founders of the firm. Brian Lange is an Associate who practices in both medical malpractice defense and civil litigation. He concentrates his practice on the defense of physicians, hospitals, nursing homes and other healthcare professionals.

Mr. Lange is a 2006 graduate of the Ohio State Moritz College of Law where he competed in Moot Court and Trial Practice. He is admitted to the Ohio State Bar and the United States District Court, Northern District of Ohio. He graduated in 2003 from Miami University with a Bachelor of Science Degree.

Prior to joining BSPH, Mr. Lange served as a judicial staff attorney to the Honorable Dick Ambrose, of the Cuyahoga County Court of Common Pleas.

Mr. Lange was most-recently recognized as a Rising Star in the 2014 edition of Ohio Super Lawyers, a distinction that recognizes the top five percent of Ohio Lawyers under the age of forty or those in practice for ten years or less.
