Directors and Officers' Liability: We act for four of the largest D&O insurers in Canada, and have handled the defense of a number of complex multi-party lawsuits brought by shareholders against directors involving allegations of securities irregularities.
Professional Liability: Our expertise includes the defense of architects, engineers, accountants, financial advisors, medical and dental professionals and construction companies.
Products Liability: We have extensive experience defending manufacturers of asbestos, recreational equipment, medical and dental equipment and implants and other industrial and consumer products.
Employment Practice Liability: We are called upon by EPL insurers to deal with a wide range of discrimination, sexual abuse, and wrongful dismissal cases to defend both the insured entity, senior management, and employees. We operate "1-800" 24 hour call lines for the benefit of insureds to avoid having employment-related problems result in actual claims.
Coverage: Our professionals provide opinions relied upon by the top insurers in Canada and worldwide when determining coverage for specific claims, calculating reserves, and interpreting policy wordings, and have appeared as counsel in multiple coverage cases before the Supreme Court of Canada, as well as other appellate courts. We have specific expertise in providing coverage advice in relation to specialty lines (including professional liability, D&O and EPL), construction and sexual abuse claims.
Underwriting Advice and Policy Wordings: We have been retained by a wide range of property, liability, E&O, D&O and EPL insurers to partner with them in developing wordings suitable for the reality of Canadian legal exposures. Our firm has developed new policy wordings and substantially modified existing forms for many of the leading D&O insurers. In addition, we have been retained to modify unique endorsements for truly facultative risks that pose unique risk management issues.
Environmental Litigation: The legislative regime pertaining to environmental responsibility has recently undergone fundamental change in British Columbia. Our firm has been in the forefront of educating risk managers and claims personnel in the new and onerous duties placed upon insurers and the broadening potential for claims exposure.
Property and Casualty Liability: Expertise is available in the area of commercial liquor liability, arson, fraud, premises liability, construction, and automotive. Our firm has a team of professionals dedicated to defending complex catastrophic bodily injury cases. Accountability and responsiveness have maintained our firm's position as lead counsel for several of Canada's largest property and casualty insurers.
Life and Disability Insurers: We have undertaken subrogation proceedings for recovery of disability benefits, as well as defending claims for life payments in circumstances of accidental death and suicide.
Cyber Privacy and Security Liability: We advise insurers with respect to Canadian privacy and intellectual property laws and adapt cyber liability policy wordings for use in Canada. We serve as national monitoring and coverage counsel for cyber liability insurers and handle the defense of claims across Canada.
Fiduciary Liability for Pension Plan Trustees and Administrators: We provide coverage advice on fiduciary liability policies for single employer and multi-employer policies. We provide monitoring services for various fiduciary liability insurers that are required to defend pension plan committee members/trustees, and the entities that are typically named as parties in actions seeking relief in relation to the conduct of pension plan obligations and benefits.
