A.M. Best and Best’s Insurance Professionals and Claims Resource have released the latest installment of the Insurance Law Podcast, a series that examines timely insurance and claims issues from a legal point of view.

This episode discusses how schools can defend against bullying claims. Bullying, including cyber bullying and hazing, continues to dominate headlines with several high-profile cases. The main risks that schools and institutions incur with bullying are being dismissive or non-responsive to claims, or failure to document efforts made to address them. The best defense to bullying claims starts with establishing anti-bullying policies, which include staff training and student education, followed by well-documented investigations of allegations and disciplinary actions taken, if appropriate. During this process, it is crucial to communicate with the parents or guardians of both the victim and the perpetrator as steps are being taken to resolve the claim.

The podcast features Attorney John J. Cloherty III from the law firm of Pierce Davis and Perritano, a litigation and trial firm with offices in Massachusetts, Connecticut and Rhode Island. Mr. Cloherty, a partner with the firm, represents municipalities, schools and school districts in defense of negligence, premises liability, negligent security, civil rights and discrimination.

Pierce Davis and Perritano is a Qualified Member of Best’s Recommended Insurance Attorneys, a claims industry resource that has featured qualified legal counsel, independent insurance adjusting services and expert service providers since 1929.
