A.M. Best and Best’s Insurance Professionals and Claims Resources have released the latest installment of the Insurance Law Podcast, a series that examines timely insurance and claims issues from a legal point of view.

This episode features attorneys John Schmidt and Lisa Gingeleskie of Lindabury, McCormick, Estabrook & Cooper in Westfield, N.J. Mr. Schmidt has more than 35 years of experience in employment litigation matters and is certified by the New Jersey Supreme Court as a civil trial attorney. Ms. Gingeleskie concentrates her practice in the areas of labor and employment law, as well as ERISA and employee benefits law.

The podcast discusses the legal impact social media has on the workplace, from a liability and a claims perspective. Employers expose themselves to potential liability if they misuse information obtained via social media during the hiring process or while disciplining existing employees under certain conditions. In addition, if an employee harasses a co-employee using employer-provided tools, the employer may be liable based upon vicarious liability for the conduct of the employee committing the harassment. As a result, employers need to be diligent in providing clear policies on social media, monitoring their employees’ use of social media on the company’s equipment and remaining up to date on all state and federal statutes pertaining to social media liability.
