A.M. Best and Best’s Insurance Professionals and Claims Resource have released the latest installment of the Insurance Law Podcast, a series that examines timely insurance and claims issues from a legal point of view.

This episode discusses the Electronic Logging Devices (ELD) mandate and its effect on future trucking litigation. In 2012, Congress passed an act requiring commercial motor vehicles to be equipped with ELDs in an effort to improve compliance with service hour regulations by monitoring a driver’s log. However, these devices also record many other types of data that can be discoverable in a lawsuit, giving a claimant’s attorney the ability to generate analytics to potentially use in case strategy. Trucking companies must be aware of what information their ELD provider records, and how that provider maintains the data so that their attorneys know what is available and discoverable after an incident.
