would have excluded certain levels of delta-9-
tetrahydrocannabinol in the blood from being
considered the cause of an injury. Delta-9 is the
primary compound that produces the psychoactive
effect, according to the Drug Enforcement
Administration.
States across the country are also considering
legislation that would legalize some psychedelics for
people afflicted with certain conditions, while other
locales saw bills to study or provide a framework
around psychedelic therapy. The NCCI said most
of this legislation does not have a direct relation to
workers’ comp.
Arizona was an exception, as Gov. Katie Hobbs
signed a bill that would authorize workers’ comp
coverage for first responders receiving PTSD
therapies that use midomafetamine, also known as
MDMA or ecstasy, provided certain conditions were
met. Enactment of the legislation is contingent on
the approval of MDMA for the treatment of PTSD
by the Food and Drug Administration by Dec. 31,
2025. The FDA in August declined to approve the
drug for PTSD therapy.

assisted therapy centers, but that legislation was
vetoed by Hobbs.
Across the country, lawmakers also wrangled with
classifications for gig workers, such as Uber drivers
and Instacart couriers.
California repealed its “ABC test” for determining
when a worker is an employee or an independent
contractor. New York, Pennsylvania, Rhode Island
and West Virginia introduced legislation to guide
these classifications during 2024. Drivers for
“transportation network companies,” or firms
like Uber and Lyft, were the focus of legislation
in Washington state, Massachusetts, Minnesota,
Virginia and Wisconsin, according to the NCCI.
The insurance implications of these bills ranged
from classification and coverage requirements for
TNCs to driver death benefits.
In March, the Department of Labor published
a final rule regarding gig worker classifications
that follows the long-standing test used by courts.
This test determines a worker’s status by looking at
six factors, including the permanence of the work
relationship and the nature and degree of control
the company has over the employee, according to a
DOL fact sheet.
